Terms of use of Casa Terrenas

These terms govern your use of the website casaterrenas.com (the “site” or “Casa Terrenas”), published by THERD SRL (“we” or “us”). By using the site, you accept these terms. If you do not agree with them, please do not use the site.

1. What the site is

The site is a search and request platform for 1 to 12-month rentals (houses, villas, apartments, studios and rooms) in Las Terrenas, Samaná (Dominican Republic).

We show listings from several agencies, property managers and public listing portals, as well as rentals submitted directly by agencies or owners. These advertisers are not necessarily our partners.
We do not publish their contact details: for a rental, you send us a request and our team replies.
We are not the landlord of rentals offered by third parties and we are not a party to the lease you sign with them.
THERD SRL may also offer rentals that it manages on behalf of their owners. These are always marked “Offered by Casa Terrenas”. In that case, the landlord's identity and the exact role of Casa Terrenas are stated to you in writing before any commitment.

2. No booking or payment on the site

The site does not allow you to book or pay online. Casa Terrenas asks you for no payment at this stage.
The “Request a viewing / information” form lets you send us a request. Only your WhatsApp number is required.
A request is neither a booking nor a rental commitment: it does not commit you to anything and does not commit the agency or owner. Our team replies on WhatsApp to confirm the rent, conditions and availability.
We do not forward your request automatically to agencies or owners. We only pass it on to them if you ticked the box provided for this in the form, after checking the rentals concerned, or, to arrange a viewing or the signing of a lease, after informing you and with your agreement (see our privacy policy).

3. Indicative information

The rents, charges, deposits, fees, lengths of stay and availability shown are indicative. They come from public sources or from information provided by agencies and owners, and are shown with their check date. They are not a quote or a firm offer.
Agencies and owners may change their rents and conditions at any time. A listing marked “To be reconfirmed” could not be checked recently; a listing marked “Probably rented” has disappeared from its source or is marked as rented there.
Availability is never guaranteed, even after you send a request.
The estimated monthly cost and the amount due on moving in are calculations based on the published information. Metered charges are not estimated, and unspecified items are flagged as such.
Conversions into another currency are indicative and dated.
The location of rentals is approximate (neighborhood or area, circle of at least 300 m). Unless stated otherwise, an illustration photo does not show the rental.
The amounts and conditions that count are those confirmed before signing and written in the lease. When you send a request, we keep a copy of the rent and conditions displayed at that moment, for reference.

4. The lease

The lease is concluded directly between you and the agency or owner (the landlord). We are not a party to it, unless stated otherwise in writing for a rental “Offered by Casa Terrenas”.
The rental conditions (rent, charges, deposit, rent in advance, agency fee, length, notice period, inventory, etc.) are those of the lease you sign. We recommend that you read it carefully before signing, ask for a receipt for every payment and read our guide to deposits and lease agreements.
Performance of the lease (handing over keys, condition of the property, deposit, charges, return) is the landlord's responsibility.

5. Viewings

Our team can arrange viewings, in person or by video, depending on the availability of the agency or owner. The exact address of a rental is only shared when a viewing is arranged. During a viewing, please respect the premises, their occupants and the instructions of the person showing you around.

6. Sponsored content and Casa Terrenas rentals

Some listings may be sponsored. They always carry a “Sponsored” label and are shown separately.
Sponsored content never changes the real order of results, in particular when they are sorted by rent or by estimated monthly cost.
Rentals managed by Casa Terrenas always carry the “Offered by Casa Terrenas” label.

7. Reports

Each listing has a “Report this listing” button. We review reports and may correct, flag or hide a listing, without being obliged to tell you what action was taken. Abusive reports are not processed.

8. Acceptable use

When using the site, you agree to:

provide truthful information and a WhatsApp number that belongs to you or that you are authorized to use;
not send abusive, repetitive or automated requests or reports, or spam;
not extract data from the site, in particular with automated tools (“scraping”);
not try to bypass security measures or disrupt the operation of the site;
not use the site for unlawful or misleading purposes.

If you are an agency or owner, you also agree to submit only rentals that you are entitled to rent out, with accurate information, and photos that you are entitled to share.

We may decline to follow up on requests that do not comply with these rules, and limit or block abusive submissions.

9. Intellectual property

The texts and illustrations on the site were created by the platform and are protected. They may not be reproduced without our permission, except where the law allows. You are welcome to share links to the site's pages.
Illustration photos under free licenses are credited on the Photo credits page. Fonts are used under the SIL Open Font License, and icons were drawn for the platform.
Agencies' names and trademarks belong to their owners; they are mentioned for information purposes only. Photos provided by agencies or owners belong to their owners.
By sending us photos and details about a rental, you allow us to publish them on the site for as long as the listing runs, after resizing them and removing their metadata where needed. You can ask for their removal at any time.

10. Liability

To the extent permitted by law:

We do our best to provide accurate, up-to-date information, but rents, conditions and availability depend on agencies, owners and public sources, and may contain errors or have changed.
We are not responsible for the performance of leases concluded with agencies or owners, for the condition of their properties or for their conduct.
We do not guarantee that the site will operate without interruptions or errors.

Nothing in these terms excludes or limits our liability where the law does not allow it, or affects the rights you have under applicable consumer protection rules, in particular Dominican Law No. 358-05 on the protection of consumer and user rights.

11. Personal data

How we use your personal data is described in our privacy policy.

12. Changes to these terms

We may change these terms, in particular to reflect changes in the service or in the law. The terms that apply are those published on this page when you use the site; a request already sent remains governed by the terms in force on the date it was sent.

13. Governing law and disputes

These terms are governed by the laws of the Dominican Republic. This choice does not deprive you of the protection afforded to you by mandatory provisions of the law of your country of residence, where they apply.
If you have a problem, please write to us first using our contact form: we will look for an amicable solution.
Failing agreement, the dispute may be brought before the competent courts of the Dominican Republic, without prejudice to mandatory rules allowing consumers to go to the courts of their place of residence. If you are a consumer in the Dominican Republic, you may also contact Pro Consumidor, the Dominican consumer protection institute.
